29 CFR 1926.451(h)(1): Each employee on a scaffold was not provided with additional protection from falling hand tools, debris, and other small objects through the installation of toeboards, screens, guardrail systems, or through the erection of debris nets, catch platforms, or canopy structures that contain or deflect the falling objects. For falling objects too large, heavy or massive to be contained or deflected, the employer did not place and secure such potential falling objects away from the edge of the surface from which they could fall: On or about October 30, 2014, employees were installing stucco to the commercial project under construction up to approximately 18 feet high on a three tier tubular welded scaffold that did not include toeboards, exposing employees to the hazard of being struck by tools and materials.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards: On or about October 30, 2014, employees were installing stucco to the commercial project under construction working from a three tier tubular welded scaffold without the employer having each employee trained in the subject matter of scaffolding, exposing the employees to a fall hazard. Note: The training shall include the following areas, as applicable: a) Any electrical hazards, fall hazards and falling object hazards in the work area; b) The correct procedures for dealing with electrical hazards and for erecting, maintaining, and disassembling the fall protection systems and falling object protection systems being used; c) The proper use of the scaffold, and the proper handling of materials on the scaffold; d) The maximum intended load and load-carrying capacities of the scaffolds used; and e) Any other pertinent requirements of this subpart.
