OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being struck-by fragments of polyvinyl Chloride (PVC) plastic pipe in the event that the PVC plastic pipe ruptured: a) 1008 Lagoon Business Loop, Montgomery, AL 36117; On or about October 23, 2014 and at times prior thereto the employer exposed employees to the hazard of being struck-by fragments of Polyvinyl Chloride (PVC) plastic pipe in the event that the PVC plastic pipe ruptured: Shop Areas - PVC plastic piping was used in exposed above ground locations to transport compressed air at 160 psi exposing employees to struck-by hazards from shards of PVC if the pipe ruptures or explodes.

29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative: a) Machinery throughout the facility; On or about October 23, 2014 and at times prior thereto the employer exposed employees to potential hazardous energies in that employees were allowed to perform maintenance and servicing on equipment without having a lock out program, without being trained in lock out tag out, and without machine specific lock out tag out procedures.
