29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.    The employer does not ensure scaffold platforms that are more than 2 feet (0.6 m) above or below a point of access that portable ladders, attachable ladders, stair towers etc. are used.  This violation was observed on or about November 10, 2014, on the west side of the construction site where an employee was exposed to fall hazards when accessing a scaffold platform which was 2 feet or more above an access point without a proper access device.     The Soriano Canopy was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(e)(1), which was contained in OSHA inspection number 312927106, Citation number 1, Item number 3 and was affirmed as a final order on 4/7/11, with respect to a workplace located at 1651 FM 528, Suite 101, Friendswood, TX 77546.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that a proper means of access is provided when accessing a scaffold platform more than 2 feet above or below a point of access.
