OSH ACT of 1970 Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards while operating a Caterpillar 950 Wheel Loader and a Caterpillar 914G Wheel Loader that did not have brakes: a. On or about November 3, 2014, employees were operating the Caterpillar 950 Wheel Loader and the Caterpillar 914G Wheel Loader without the use of brakes, exposing the employees to being struck by the objects they run into due to not being able to stop the loaders.
