Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by and crushing injuries where a JLG 3246ES scissor lift was not used in accordance with the manufacture's Operation and Safety Manual.    a. Site- Employees erecting an industrial steel storage rack system were exposed to struck by and crushing injuries where a JLG 3246ES scissor lift was elevated to approximately 25 feet and was supporting a free standing steel upright, 30 feet tall, and weighing approximately 500 pounds by resting the upright against the platform guardrail. On or about October 29, 2014 a forklift struck the scissor lift while supporting the steel upright. The scissor lift was knocked over and the free standing 30 foot steel upright fell on top of the forklift which caused the incident.

Site- Employees erecting an industrial steel storage rack system were exposed to fall, struck by, and crushing injuries where a Yale ERC050 forklift was operated without adhering to the Operating Safety Rules and Practices as set forth in section 604 Traveling of ANSI B56.1-1969. On or about October 29, 2014 a Yale ERC050 forklift struck a scissor lift with its work platform elevated approximately 25 feet and knocked the scissor lift over. The forklift was traveling in reverse with an obstructed view to the scissor lift and with the load engaging means elevated to approximately 25 feet without a load.
