OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of a flash fire from a build up of flammable gas. On or about November 4, 2014 and at times thereafter, two separate employees on two consecutive days turned on a Vulcan V60F conventional gas oven where a faulty thermomagnetic safety valve allowed the collection of flammable gas and a subsequent ignition from a burner above when the door was opened. Employees were exposed to the flash fire hazard from a build-up of flammable gas.

29 CFR 1910.157(g)(1): An educational program was not provided for all employees to familiarize them with the general principles of fire extinguisher use and the hazards involved with incipient stage fire fighting. On or about 17 September 2014, and at times prior thereto, employees are expected to use portable fire extinguishers as a means to eliminate incipient stage fires without the employer providing training, exposing employees to various fire hazards.

On or about 17 November 2014, and at times prior thereto, fire extinguishers mounted on the wall in the restaurant guest seating area and kitchen were not identified so that they would be readily accessible, exposing the employees working in the area to various fire hazards.
