The missing safety wheel guard exposed the employees using this grinder to the hazards of flying metal chips, sparks, as well as fragments of the wheel, if it broke.

Employees performing this work were exposed to such hazardous materials as Henkel H8600 Part A and B, containing methyl methacrylate, galvanized hot rolled steel plate, Harris Lead Solder, Dynaflux Anti-Spatter 200A containing methylene chloride, zinc dust and welding fumes including iron oxide fume, manganese and zinc oxide fume. The employer did not establish and implement a written hazard communication program that included a list of hazardous chemicals.

Air sampling conducted for 403 minutes on January 23, 2015, revealed that the worker was exposed to a time weighted average for zinc oxide fume of 5.2 milligrams per cubic meter of air. Zero exposure was assumed for 77 minutes of the 480 minute exposure time.

29 CFR 1910.1000(e): Feasible administrative or engineering controls were not determined and implemented to achieve compliance with the limits prescribed in 29 CFR 1910.1000(a) through (d): (a) On or about January 23, 2015, in the welding area, for a welder fabricating bus parts at a fixed work station. Air sampling conducted for 403 minutes on January 23, 2015, revealed that the worker was exposed to a time weighted average for zinc oxide fume of 5.2 milligrams per cubic meter of air. Zero exposure was assumed for 77 minutes. The employer did not implement feasible engineering and administrative controls to achieve compliance with 1910.100(a)(2) . Examples of feasible engineering controls include: purchasing a commercially available portable local exhaust system, training workers on the effective use of engineering controls and the importance of keeping their heads out of the path of the fumes, operating all general exhaust fans in the building and/or erecting a welding bench with a slotted hood to perform this work.
