29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified per 29 CFR 1910.178(l):    (a)Denison Development & Construction LLC, at 345 Relay Road, Aspen, CO: On and preceding 11/25/14, Denison Development & Construction LLC did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified per 29 CFR 1910.178(l).  The foreman for Denison Development & Construction LLC operated a Gehr model RS8 rough terrain forklift.  A Star Industries Safety Work Platform model 1208G was used to elevate Global Work Resources LLC employees.  Denison Development & Construction LLC did not provide training and an evaluation of the operator of the forklift.  This condition exposed Global Work Resources LLC employees to an approximate eight foot fall hazard.

29 CFR 1926.50(b): Provisions were not made prior to commencement of the project for prompt medical attention in case of serious injury:    (a)Denison Development & Construction LLC, at 345 Relay Road, Aspen, CO: On or about 11/25/14, Denison Development & Construction LLC did not make provisions prior to commencement of the project for prompt medical attention in case of serious injury.  Denison Development & Construction LLC directed the activities of workers from Global Work Resources LLC.  Three employees of Global Work Resources LLC performed maintenance activities at the construction site.  Two employees of Global Work Resources LLC were assigned to remove snow from a garage.  The workers were elevated by a Gehr model RS8 rough terrain forklift.  The Star Industries Safety Work Platform model 1208G had not been secured to the forklift.  The work platform slid off the forklift blades while the workers were upon the platform.  The platform and workers fell approximately eight feet to the ground.  One worker sustained a serious closed head injury.  The injured worker did not receive prompt medical attention.

Denison Development & Construction LLC directed the activities of workers from Global Work Resources LLC.  Three employees of Global Work Resources LLC performed maintenance activities at the construction site.  Two employees of Global Work Resources LLC were assigned to remove snow from a garage.  The workers were elevated by a Gehr model RS8 rough terrain forklift.  The Star Industries Safety Work Platform model 1208G had not been secured to the forklift. Denison Development & Construction LLC directed the activities of workers from Global Work Resources LLC.  Three employees of Global Work Resources LLC performed maintenance activities at the construction site.  Two employees of Global Work Resources LLC were assigned to remove snow from a garage.
