29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  a) Jobsite: Scaffold - WVM Construction did not have a written hazardous communication program at the workplace.  Employees conducting bricklaying operations were handling the hazardous chemical Rainbow Bond Colored Masonry Cement, on or about 11/20/14.

29 CFR 1926.451(b)(1): Platform(s) on all working levels of scaffolds, were not fully planked or decked between the front uprights and guardrail supports such that the space between adjacent units, and the space between the platform and the uprights is no more than 1 inch wide:    a) Jobsite: Scaffold - The working level of the supported tubular welded frame scaffold was not fully planked or decked between the front and rear uprights thus exposing employees to a fall hazard of approximately twenty six (26) feet, on or about 11/20/14.

29 CFR 1926.451(c)(1): Supported scaffolds with a height to base width (including outrigger supports, if used) ratio of more than four to one (4:1) were not restrained from tipping by guying, tying, bracing, or equivalent means, as set forth in subparagraphs (i) - (iii) of this paragraph.    a) Jobsite: Scaffold - The supported tubular welded frame scaffold measuring approximately 26 feet in elevation and 5 feet in width, was not restrained from tipping or falling over by guying, tying, bracing, or equivalent means. An employee was conducting bricklaying operations from the 3rd working platform, approximately 21 feet above ground level, on or about 11/20/14.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.    a) Jobsite: Scaffold - Employees were not provided with a safe means of access and/or egress to a supported tubular welded frame scaffold, exposing employees to a fall hazard of approximately twenty-six (26) feet.  Employees were using the side frame of the scaffold to access and/or egress the working levels, on or about 11/20/14.

The scaffold was erected around the power line, on or about 11/20/14.

Employees were conducting bricklaying operations and were exposed to fall hazards while working from the third working platform approximately 21 feet above ground level, on or about 11/20/14.
