OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: Total Comfort Service Center, Inc. dba Total Comfort Solutions - on or about September 16, 2014, employees exposed to inhalation hazards resulting from exposure to hydrogen sulfide were not required to perform daily calibration checks of personal monitors intended to alert employees to the presence of hydrogen sulfide. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: Total Comfort Service Center, Inc. dba Total Comfort Solutions - on or about September 16, 2014, at the International Paper Company facility located at 4278 Mike Padgett Highway in Augusta, Georgia, where employees were required to carry escape respirators by company policy and due to the possible presence of inhalation hazards related to hydrogen sulfide, the employer had not developed and implemented a written Respiratory Protection program. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
