Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards:   a) Warehouse and distribution center: On December 4, 2014, and at times prior thereto, an employee was operating a Clark electric powered industrial truck model TMX25, S/N TMX250-1924-9597KF and not wearing the supplied seatbelt. The employer did not establish and enforce a work rule requiring the use of seatbelts by powered industrial truck operators.  Note: Abatement certification IS required for this item.

29 CFR 1910.151(c): Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use:  a)  Warehouse: On December 4, 2014, and at times prior thereto, employees were exposed to electrolyte splash and hydrogen gas when filling the electric forklift / pallet jack batteries and charging them.
