OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, employees were exposed to fire and a hazardous atmosphere as a result of welding in a confined space:  Jobsite was located at Phoenix Soil, 58 North Washington Street in Plainville, Connecticut:  On or about December 4, 2014, employees were exposed to hazards created by entering and MIG welding inside a steel vessel that was being manufactured on-site.  The company had not developed and implemented adequate confined space entry procedures to be followed before and during entries into the vessel.  A.  Atmospheric testing was not conducted in accordance with established guidelines for the types of tests needed.  B.  An Attendant was not stationed outside the point of entry with the ability to constantly communicate with the Entrant.  C.  The company had not developed and implemented procedures to either summon rescue and emergency services or to rescue Entrants from permit spaces.
