Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employees were exposed to the hazard of being crushed:    a)  On or about November 26, 2014, and times prior to that date, employees were exposed to crushing hazards in the event of a roll-over/tip over created by operating the Allis-Chalmers lift truck, model # FTI-20-24PS, serial #17103263 and Hyster Company lift truck, no model number, serial #586051 without adequate restraint systems being installed or used.    Abatement note: Among other methods, one feasible and acceptable method to correct this hazard would be to install seat belts on the truck being operated without them and to enforce the requirement that the operators of the powered industrial truck use the seat belts.

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  (a)  On or about November 26, 2014, and times prior to that date, the employer did not ensure the operators of powered industrial trucks were adequately trained or evaluated, exposing the employees to potential struck-by hazards.
