29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards:Note: Toeboards are only required when persons can pass, there is moving equipment or there is equipment with which falling materials could create a hazard. At the time of the inspection, the following area were not equipped with standard guardrails or fall protection; a) The mezzanine above the office was missing portions of the top rail and mid-rail exposing employees to a fall of greater than 8 feet to the concrete floor. b) Truck drivers were operating the truck mounted loader from a work platform greater than 12 feet above the ground with no guardrails or seat belts to prevent a fall.
