29 CFR 1910.22(b)(2): Permanent aisles and passageways were not appropriately marked: a) For employees working inside the warehouse located at 5102 South 16th Ave., Tampa, FL 33619, as observed on or about 12/17/2014 permanent passageways marks were not present exposing employees to struck by hazard by the 50 Toyota forklifts that are being operated throughout the warehouse.

29 CFR 1910.23(c)(1): Open-sided floor(s) or platform(s) 4 feet (1.22 m) or more above the adjacent floor or ground level were not guarded by standard railings (or the equivalent as specified in 29 CFR 1910.23(e)(3)(i) through (v)), on all open sides: (a) Employees operating the forklifts at 5102 South 16th Ave., Tampa, FL 33619, as noted on or about 12/17/2014 were exposed to a 51 inch fall from the rail dock in that no guarding was installed to prevent employees operating the Toyota forklifts from skidding off the rail dock. Lack of guarding resulted in an employee to fall of the rail dock while operating the forklift on or about 11/25/2014.

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): (a) Temporary Employee operating the forklift at 5102 South 16th Ave., Tampa, FL 33619, as noted on or about 11/25/2014 was not provided with class room training and evaluation on the Toyota fork lift that he was operating. Lack of class room training can result in improper operations exposing employees to struck by hazards.
