29 CFR 1926.501(b)(13): Employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were other provisions of paragraph (b) of this section used to provide an alternative fall protection measure: On the residential roof located at 1321 S 25th Street, Omaha, NE 68108: The employer is failing to ensure that employees engaged in residential construction activities were protected from falls while working at heights greater than 6 feet from lower levels. On or about December 10, 2014; employees of Jose Arnando Garcia Roofing were performing residential roofing activities without conventional fall protection and exposed to fall distances greater than 10.8 feet.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: At the jobsite located at 1321 S 25th Street, Omaha, NE: The employer is failing to provide a training program to ensure that employees are able to recognize and minimize hazards when exposed to falls greater than 6 feet. On December 10, 2014 employees were observed performing residential construction activities while exposed to fall heights of approximately 10.8 feet without protective measures such as but not limited to guardrails, safety nets and or personal fall protection systems.
