29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary: The employer does not protect employees from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations. This violation was observed on or about December 16, 2014, at the site at the intersection of Fry Rd. and Windystone where employees were exposed to a struck-by hazard when working in an excavation without protecting employees from excavated or other materials or equipment that could fall or roll into the excavation. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into the excavation.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c): The employer does not protect employees from excavation cave-ins by an adequate protection system. This violation was observed on or about December 16, 2014 at the intersection of Fry Rd. and Windystone where an employee was exposed to a crushed-by hazard when working in an excavation without being protected from cave-ins by an adequate protection system. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are protected from crushed-by injuries form cave-ins while working in excavations.
