OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a.) Hytech Tool & Design Company/12076 Edinboro Road, Edinboro, PA On or about December 30, 2014 and at times prior thereto, employees were potentially exposed to fire and explosion hazards from dust collectors located inside the building. Dust collectors including but not limited to the Torit dust collector model SDF6 was located inside the building and was not equipped with any devices to mitigate a potential dust explosion. The dust collector collected combustible graphite dust. b.) Hytech Tool & Design Company/12076 Edinboro Road, Edinboro, PA On or about December 30, 2014 and at times prior thereto, employees were potentially exposed to fire and explosion hazards from dust collectors that were not equipped with devices and systems to prevent the propagation of explosions and associated flame fronts from the dust collector through the associated dust collection system duct work. Torit dust collector model SDF6 was not equipped with approved devices to prevent the propagation of a dust explosion and associated flame fronts throughout the dust collection system and associated duct work. The dust collector collected combustible graphite dust.

29 CFR 1910.147(d)(4)(i): Lockout or tagout devices were not affixed to each energy isolating device: a.) Hytech Tool & Design Company/12076 Edinboro Road, Edinboro, PA On or about December 30, 2014 and at times prior thereto, employees performed servicing/maintenance work on machines/equipment that include but were not limited to the Oakamoto grinder. The servicing and maintenance work included but was not limited to changing the grinding wheel. The equipment was not locked out while changing the grinding wheel. b.) Hytech Tool & Design Company/12076 Edinboro Road, Edinboro, PA On or about December 30, 2014 and at times prior thereto, employees performed servicing/maintenance work on machines/equipment that include but were not limited to the Sharnoa Vertical Milling machine. The servicing and maintenance work included but was not limited to cleaning out metal chips/debris from the machine. The equipment was not locked out while cleaning the metal/chips debris from the machine.

Hytech Tool & Design Company/12076 Edinboro Road, Edinboro, PA On or about December 30, 2014 and at times prior thereto, employees performed servicing/maintenance work on machines/equipment that include but were not limited to the Oakamoto grinder, Sharnoa Vertical Milling machine, and CNC machines. Periodic inspections had not been conducted with all the employees who conduct servicing/maintenance work.

29 CFR 1910.133(a)(3): The employer did not ensure that each affected employee who wore prescription lenses while engaged in operations that involved eye hazards wore eye protection that incorporated the prescription in its design, or wore eye protection that could be worn over the prescription lenses without disturbing the proper position of the prescription lenses or the protective lenses: a.) Hytech Tool & Design Company/12076 Edinboro Road, Edinboro, PA/ Sharnoa Vertical Milling machine On or about December 30, 2014 and at times prior thereto, employee the Sharnoa Vertical Milling machine and exposed to potential eye injury hazards from metal chips and shavings in that the employee was not wearing eye protection. The employee was wearing standard prescription eye wear that did not meet the ANSI Standard for industrial eye protection. In addition, the employees standard prescription glasses were not outfitted with side shields that were not designed for machine operator eye hazards.
