OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a) Caretek Inc. dba Colorado Timberline at 9911 E 47th Avenue, Denver, CO: On and preceding 1/2/15, Caretek Inc did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to injurious light radiation. Employees operated a Radian Laser System model 115-3AX Class IV carbon dioxide laser. The interlock for the beam path enclosure for the Class IV CO2 laser had been overridden. The Class IV laser was operated with the beam path not completely enclosed. This condition exposed employees to a non-ionizing radiation hazard. (b) Caretek Inc. dba Colorado Timberline at 9911 E 47th Avenue, Denver, CO: On and preceding 1/2/15, Caretek Inc did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to injurious light radiation. Employees operated a Chinese Class IV Nd:YAG laser. The beam path was not enclosed. The beam was targeted at a reflective surface. This condition exposed employees to a non-ionizing radiation hazard. (c) Caretek Inc. dba Colorado Timberline at 9911 E 47th Avenue, Denver, CO: On and preceding 1/2/15, Caretek Inc did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to injurious light radiation. Employees operated a Radian Laser System model 115-3AX Class IV carbon dioxide laser and a Chinese Class IV Nd:YAG laser. Employees were not provided training with regards to the hazards of lasers and appropriate measures to protect themselves from exposure to hazardous light radiation. This condition exposed employees to a non-ionizing radiation hazard. Abatement Note: Among other methods, feasible abatement methods include: (1) Compliance with ANSI/LSI Z136.1 "American National Standard for Safe Use of Lasers", including but not limited to the following: (a) Re-engage interlock on Radian Class IV CO2 laser beam path enclosure; (b) Installation of beam path enclosure on Chinese Class IV Nd:YAG laser; (c) Enclosure of open beam path of any other Class IV CO2 lasers; (d) Calculate NHZ and ensure enclosure of beam path and removal of reflective surfaces for each laser; (e) Assign Laser Safety Officer; and (f) Provide laser safety training to operators.

Employees conducted operations which included exposure to hazardous nonionizing radiation and flying particles. Hazardous operations included, but are not limited to the following: 1. Exposure to Class IV carbon dioxide and Class IV Nd:YAG laser's non-ionizing radiation; 2. Exposure to flying particles when processing printed or engraved materials; and 3. Exposure to lacerations when handling rough surfaced materials.

Protective eyewear for the appropriate wavelength and power of each laser was not available. This condition exposed employees to a non-ionizing radiation hazard.
