29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury:  On or about January 5, 2015, the employer did not provide hazard recognition training for employees performing activities including, but not limited to, working on the roof of the newly constructed apartment complex frame without any form of fall protection and was exposed to a fall hazard greater than 6-feet.

29 CFR 1926.501(b)(13): Employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system or personal fall arrest systems:  On or about January 5, 2015, five employees were observed working on a roof installing roof shingles. Two employees were wearing fall protection gear and tied down but three other employees working alongside of them were not and were exposed to a fall hazard greater than 6-feet.  Lopez Roofing was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(10), which was contained in OSHA inspection number 961310, citation number 01, item number 001 and was affirmed as a final order on April 30, 2014, with respect to a workplace located at 106637 Edgemere, El Paso, TX 79925.
