29 CFR 1926.1053(b)(1):     When portable ladders were used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access.    On 1/06/2015, employees from Winkler Construction LLC were working on a roof of a residential building located the southeast corner of Fieldstone Estates Drive and Fieldstone Estates Drive in Wentzville, MO.  They were using ladders improperly to access the roof.  The ladders were not extended to three feet beyond the landing surface or edge of the roof.

29 CFR 1926.501(b)(13):     "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest systems.    On 1/06/2015, employees from Winkler Construction LLC were working on a roof of a residential building located the southeast corner of Fieldstone Estates Drive and Fieldstone Estates Drive in Wentzville, MO.  They were not utilizing guardrail systems, a safety net system, or personal fall arrest systems.  The owner and an employee were observed working on the roof of the building without fall protection, exposing them to a fall to the ground below.    Tony Winkler Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 315651166, citation number 1, item number 3A, and was affirmed as a final order on 11/26/2011, with respect to a workplace located at 117 Killdeer Circle, Moscow Mills , MO 63362.
