29 CFR 1910.95(g)(5)(i): The employer did not establish, within 6 months of an employee's first exposure at or above the action level, a valid baseline audiogram against which subsequent audiograms can be compared:    a) Gwinnett Clean and Beautiful, Duluth, GA - An employee supervising the Single Stream Line and operating the heavy equipment was exposed to noise levels at a time weighted average (TWA) of 90.7 dBA, exceeding the action level of 85 dBA, which represented his 8 hour day.  A baseline audiogram had not been conducted, on or about 12/9/14.    b) Gwinnett Clean and Beautiful, Duluth, GA - An employee operating the forklift and bobcat was exposed to noise levels at a time weighted average (TWA) of 87.9 dBA, exceeding the action level of 85 dBA, which represented his 8 hour day. A baseline audiogram had not been conducted, on or about 12/9/14.    In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.95(k)(1): The employer did not train each employee who is exposed to noise at or above an 8-hour time-weighted average of 85 decibels in accordance with the requirements of 29 CFR 1910.95(k). The employer did not institute a training program and ensure employee participation in the program:    a) Gwinnett Clean and Beautiful, Duluth, GA - An employee supervising the single stream line and operating the forklift and bobcat was exposed to noise levels at a time weighted average (TWA) of 90.7 dBA, Training in accordance with the standard had not been conducted, on or about 12/9/14.      b) Gwinnett Clean and Beautiful, Duluth, GA - An employee operating the forklift and bobcat was exposed to noise levels at a time weighted average (TWA) of 87.9 dBA. Training in accordance with the standard had not been conducted, on or about 12/9/14.    In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:    Gwinnett Clean and Beautiful, Duluth, GA - Maintenance and repairs are made by employees on equipment such as the three baler machines, forklifts, and conveyors.  The balers has electrical and hydraulic energies.  A lockout/tag out program had not been developed and implemented,  on 11/12/14.   In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
