29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: (a) Pro Auto Body, Inc. 892 Park Avenue East, Mansfield, Ohio: On or about January 13, 2015, the employer required an employee to use a 3M tight-fitting, cartridge-style, half-mask respirator while working. The employer did not provide a medical evaluation of the employee to determine if the employee was able to safely wear the respirator. The employee was exposed to paint solvents and at risk of serious injury if using the negative pressure respirator aggravated an underlying medical condition.
