OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a) Cotton Gin, on or about January 14, 2015, the employers housekeeping practices did not include removing accumulations of cotton dust from vertical and horizontal ledges, metal pipes electrical equipment and on the floor around the gin equipment and equipment used unsafely cleaning with compressed air, which exposed employees to fire, combustion, and deflagration hazards.

29 CFR 1928.57(d)(1)(i): The main drive and miscellaneous drives of gin stands was be completely enclosed, guarded by location, or guarded by railings (consistent with the requirements of paragraph (a)(7) of this section). Drives between gin stands shall be guarded so as to prevent access to the area between machines: a) At the cotton gin, #1 Feeder-Lummus Machine, on January 14, 2015, and times prior thereto, the employer failed to ensure that the main and miscellaneous drives were guarded, exposing employees to entanglement and amputation hazards. b) a) At the cotton gin, #2 Feeder-Lummus Machine, on January 14, 2015, and times prior thereto, the employer failed to ensure that the main and miscellaneous drives were guarded, exposing employees to entanglement and amputation hazards. c) a) At the cotton gin, #3 Feeder-Lummus Machine, on January 14, 2015, and times prior thereto, the employer failed to ensure that the main and miscellaneous drives were guarded, exposing employees to entanglement and amputation hazards.

29 CFR 1928.57(d)(1)(iv): Pulleys of V-belt drives shall be completely enclosed or guarded by location whether or not railings are present. The open end of the pulley guard shall be not less than 4 inches from the periphery of the pulleys: a) At the cotton gin, on or about January 14, 2015, and times prior thereto, the employer failed to ensure that a pulley of a V-belt drive at the #1 and #2 Lint Cleaner machines were guarded, exposing employees to entanglement and amputation hazards. b) At the cotton gin, on or about January 14, 2015, and times prior thereto, the employer failed to ensure that a pulley of a V-belt drive at the #1 Feeder-Lumnus machine was guarded, exposing employees to entanglement and amputation hazards. c) At the cotton gin, on or about January 14, 2015, and times prior thereto, the employer failed to ensure that a pulley of a V-belt drive at the #2 Feeder-Lumnus machine was guarded, exposing employees to entanglement and amputation hazards. d) At the cotton gin, on or about January 14, 2015, and times prior thereto, the employer failed to ensure that a pulley of a V-belt drive at the #3 Feeder-Lumnus machine was guarded, exposing employees to entanglement and amputation hazards. e) At the cotton gin, on or about January 14, 2015, and times prior thereto, the employer failed to ensure that a pulley of a V-belt drive at the Incline Cleaner was guarded, exposing employees to entanglement and amputation hazards. f) At the cotton gin, on or about January 14, 2015, and times prior thereto, the employer failed to ensure that a pulley of a V-belt drive at the #1 Burner was guarded, exposing employees to entanglement and amputation hazards. g) At the cotton gin, on or about January 14, 2015, and times prior thereto, the employer failed to ensure that a pulley of a V-belt drive at the #2 Burner was guarded, exposing employees to entanglement and amputation hazards.
