29 CFR 1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).               (a)   Sparq home, 901 S Jason St. #B, Denver, CO 80223: On and before January15, 2015, the employer did not ensure that the employees were trained in the safe operation of powered industrial trucks. This condition exposed the employee to the hazard of improper forklift operation.       Abatement Note:  Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").       Abatement Note:  Training shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.

29 CFR 1910.1200(e)(1):  The employer did not develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met:          (a)               Sparq Home, 901 S Jason St. #B, Denver, CO 80223:  The employer did not develop, implement, and maintain at the workplace specific written hazard communication program which describes how the specified in paragraphs (f), (g), and (h) of this section for labels of warning, material safety data sheets, and employee information and training will be met. This condition exposes employees to respiratory hazards associated with silica, carbon monoxide and air conditioning coolants. 29 CFR 1910.1200(h)(1):  Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and  safety data sheets.          (a)   Sparq home, 901 S Jason St. #B, Denver, CO 80223: On and before january15, 2015, the employer did not provide employees with information on the health hazards of the chemicals they are working with. This lack of knowledge exposed employees to hazards associated with chemicals such silica. 29 CFR 1910.132(d)(1): The employer shall assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE).       (a) Sparq Home, 901 S Jason St. #B, Denver, CO 80223:The employer did not assess the workplace to determine if hazards were present, or were likely to be present, which necessitated the use of personal protective equipment in that stone fabrication tasks were not assessed to determine PPE requirements.  Lack of a PPE Hazard assessment may prevent employees from choosing and using the correct PPE for a task.      Abatement Note: If such hazards are present, or likely to be present, the employer shall:  Select, and have each affected employee use, the types of PPE that will protect the affected employee from the hazards identified in the hazard assessment;  Communicate selection decisions to each affected employee; and,  Select PPE that properly fits each affected employee. Note: Non-mandatory Appendix B contains an example of procedures that would comply with the requirement for a hazard assessment. 29 CFR 1910.134(d)(1)(iii):  The employer did not evaluate the respiratory hazard(s) in the workplace including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminants chemical state and physical form:     (a) Sparq Home, 901 S Jason St. #B, Denver, CO 80223: On and before January15, 2015, the employer did not conduct air monitoring to determine employees exposure to the air contaminants associated with the welding, and painting operations performed at the job site.  This condition exposed employees to respiratory hazards.        Abatement Note:  Abatement certification is not required for this item.
