29 CFR 1910.134(c)(2)(ii): The employer must establish and implement those elements of a written respiratory protection program necessary to ensure that any employee using a respirator voluntarily is medically able to use that respirator, and that the respirator is cleaned, stored, and maintained so that its use does not present a health hazard to the user. Exception: Employers are not required to include in a written respiratory protection program those employees whose only use of respirators involves the voluntary use of filtering facepieces (dust masks):    On or about January 16, 2015, in the facility, employees required to perform concrete and mortar mix manufacturing were provided and used half-mask air-purifying respirators voluntarily during packaging (bag, box) and dryer operations.  The employer did not establish and implement those elements of a written respiratory protection program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator.

29 CFR 1910.147(c)(6)(i): The employer shall conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirements of this standard are being followed:    On or about January 16, 2015, in the facility, maintenance employee(s) required to service and maintain machines and equipment, including, but not limited to, compressors and blender/mixers, were exposed to the potential hazard of unexpected energization or start up of the machines and equipment.  The employer did not conduct a periodic inspection of the energy control procedures at least annually to ensure that the procedure and the requirements of the standard were being followed.

29 CFR 1910.1200(h)(3)(ii): Employers shall provide employees with effective training on the physical, health, simple asphyxiation, combustible dust, and pyrophoric gas hazards, as well as hazards not otherwise classified, of the chemicals in the work area:    On or about January 16, 2015, in the facility, employees required to perform concrete and mortar mix manufacturing including, but not limited to, packaging and dryer operations, were exposed to contact with crystalline silica.  The employer did not provide each employee with effective training on the associated health hazards including, but not limited to, silicosis.
