The employer allowed his employee to work in close proximity to backhoe activity while not wearing a hardhat exposing the employee to head injuries from impacts.       Condition occurred on or about 01/16/15.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:    a) 26 Dewey Avenue, Colonia, NJ 07067. The employer allowed his employee to work in a trench/excavation with the spoil piles placed at the edge of that trench/excavation exposing the employee to struck-by and crushing hazards when the spoils were not a minimum 2 foot back from the edge nor were they retained.     Condition occurred on or about 01/16/15.

Excavation was not made entirely in stable rock and exceeded 5 foot in depth:      a) 26 Dewey Avenue, Colonia, NJ 07067.  The employer allowed his employee to work in trench/excavation in excess of 5 foot deep with no protective systems in place exposing the employee to struck-by and engulfment hazards.      Condition occurred on or about 01/16/15.
