29 CFR 1910.146(d)(5)(ii): Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not evaluate permit space conditions when entry operations were conducted by testing or monitoring the permit space as necessary to determine if acceptable entry conditions were being maintained during the course of entry operations: (a)NRE Field Services, LLC at O St & N 23rd Ave, Greeley, CO 80631: On and before December 13th, 2015, the employer did not evaluate permit space conditions when entry operations were conducted by testing or monitoring permit spaces as necessary to determine if acceptable entry conditions were being maintained during the course of entry operations. Employees entered 500 bbl frac tanks to clean the tanks which were considered to be permit-required spaces. The spaces were not ventilated during entry operations. Entry operations of frac tanks that contained hydrocarbons lasted approximately 8 hours. The employer did not ensure that continuous or frequent periodic monitoring took place during entry operations. This condition exposed employees to confined space hazardous atmospheres.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and maintain a written hazard communication program which at least described how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met: (a)NRE Field Services, LLC at O St & N 23rd Ave, Greeley, CO 80631: On and before December 13th, 2015 the employer did not develop and implement a written hazard communication program that pertains to the cleaning of frac tanks. The chemicals inside frac tanks include, but are not limited to: benzene; toluene; ethylbenzene and xylenes. The condition exposed employees to chemical hazards.
