OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by hazard from the use of an aerial lift on a slope:    Jobsite:  North side of building at 530 Columbia Road    An aerial lift was used on a excessively sloped road.  Employees continued to use the aerial lift although the tillt alarm was sounding.

29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated. Jobsite:    Aerial lift users were not adequately trained in its safe use.    Chapman Waterproofing Company, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.454 (a), which was contained in OSHA inspection number 313795841, citation number 1, item number 5, and was affirmed as a final order on May 25, 2010, with respect to a workplace located at Faneuil Hall in Boston, MA.
