29 CFR 1926.501(b)(2): 1926.501(b)(2)(i): Each employee who was constructing a leading edge 6 feet or more above lower levels was not protected from falling by guardrail systems, safety net systems, or personal fall arrest systems: a) At the jobsite on the third floor deck, on or about 1/23/15: Employees were constructing a deck onto truss joists, spaced 20 inches apart, exposing them to falls of 10 feet to the lower level and 23 feet to ground when at the building edge without fall protection of any kind. Abatement certification must be submitted for this item.

29 CFR 1926.501(b)(14): The employer did not ensure that each employee working on, at, above, or near wall openings (including those with chutes attached) where the outside bottom edge of the wall opening was 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening was less than 39 inches (1.0 m) above the walking/working surface, were not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system. a) At the jobsite, on the 2nd floor, on or about 1/23/15: Employees were working in close proximity to 5 floor to ceiling wall openings where guardrails were not installed, exposing workers to falls of 13 feet to ground. b) At the jobsite, on the 2nd floor, on or about 1/23/15: Employees were working in close proximity to and transiting an area where a partition was installed with studs 20 inches on center, and where no guardrail was installed.
