29 CFR 1926.451(c)(2)(v): Fork-lifts shall not be used to support scaffold platforms unless the entire platform is attached to the fork and the fork-lift is not moved horizontally while the platform is occupied:  JOBSITE:  The wooden pallet platform of the supported scaffold, which was supported by the forks of the Genie forklift truck for the employees installing roofing and gutters to a system engineered metal building, was not positively secured or attached to the forks.

29 CFR 1926.602(c)(1)(viii): A lift truck, equipped with vertical only, or vertical and horizontal controls elevatable with the lifting carriage or forks for lifting personnel, did not have the following precautions to include (A) Use of a safety platform firmly secured to the lifting carriage and/or forks (B) Means whereby personnel on the platform can shut off power to the truck (C) Protection from falling objects as indicated necessary by the operating conditions.  JOBSITE:  The Genie forklift truck, which was used to support and raise the wooden pallet supported scaffold for the employees installing roofing and gutters to a metal building did not have the minimum precautions for above (A), (B) and (C) of this section, 29 CFR 1926.602(c)(1)(viii).

29 CFR 1926.602(c)(1)(vi): Industrial truck(s) in use did not meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks. Section 502, "Stability". Some of the conditions which may affect the stability are ground and floor conditions, grade, speed, loading, battery weight, dynamic and static forces, and the judgment exercised by the operator:  JOBSITE:  One of the wheels of the Genie forklift truck (Truck), which was used to support wooden pallet supported scaffold which was used by employees to install roofing and gutters to a metal building, was raised up due to the Truck was parked on uneven and high graded surface area.  On or about 01/22/2015, the above Truck tipped over while three (3) employees were on the working platform of the above supported scaffold, and the three(3) employees sustained severe injuries from the incident.
