29 CFR 1926.651(i)(1): Where the stability of adjoining buildings, walls, or other structures was endangered by excavation operations, support systems such as shoring, bracing, or underpinning were not provided to ensure the stability of such structures for the protection of employees: a) Temporary shoring/ bracing was not provided to support the unsupported overhanging foundation wall when the employer was excavating underpin sections, including section 14D. The face of the wall was 18 inches wider than the wall footing causing an unsupported overhang condition. Location: 326 W 37th Street, New York, N.Y. On or about 9/23/2014 NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.651(k)(1): The employer did not ensure that: Daily inspections of excavations, the adjacent areas, and protective systems shall be made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions: a) A competent person did not conduct daily inspections of the excavation and underpinning work being completed at the site. Employees were exposed to foundation wall collapse hazard; the front face of the wall came loose and fell out where employees were working. Location: 326 W 37th Street, New York, N.Y. On or about 9/23/2014 NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when: (i) Excavations are made entirely in stable rock; or (ii) Excavations are less than 5 feet in depth and examination of the ground by a competent person provides no indication of a potential cave-in: a) An excavation protective system was not provided when employees were doing foundation underpinning work in a 10 ft deep trench. Protective system such as but not limited to wood timber framed underpin approach pit boxes as designed and required on the Engineer's project design plan, were not used.
