29 CFR 1910.178(l)(2)(ii): Training must consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.      (a) On February 5, 2015: Employer failed to maintain a proper powered industrial truck training program. The Powered Industrial Truck Operator must receive initial training: in operating instructions, warnings, and precautions for the types of trucks the operator will be operating. This training must come in the form of formal instruction, practical training, and an evaluation of the operators performance in the workplace. The employer must certify that each operator has been trained and evaluated. The training provided was only in the form of practical training.

29 CFR 1904.29(a): You must use OSHA 300, 300-A, and 301 forms, or equivalent forms, for recordable injuries and illnesses. The OSHA 300 form is called the Log of Work-Related Injuries and Illnesses, the 300-A is the Summary of Work-Related Injuries and Illnesses, and the OSHA 301 form is called the Injury and Illness Incident Report.    (a) On February 5, 2015: Employers failed to provide the OSHA 300, 300-A, and 301 forms for recordable injuries from the past three years along with any injuries in 2015. The owner did not maintain injury illness logs at the time of inspections.

29 CFR 1910.1200(h)(3)(iv): The details of the hazard communication program developed by the employer, including an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employees can obtain and use the appropriate hazard information.    (a) On February 5, 2015: The employer failed to train employees on the new Hazard Communication Standard which was required as of December 1, 2013. The Employees were exposed to oils, coolants, and cleaning supplies.
