29 CFR 1910.178(l)(1)(ii): Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer shall ensure that each operator has successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5). a) Eastern Metal Recycling Eastern Holding - The employer did not provide employees operating the Hyster #50 propane powered industrial trucks with comprehensive training. Operating powered industrial trucks without training increases employee exposure to struck by hazards. This was observed on February 6, 2015.

29 CFR 1910.178(q)(7): Industrial trucks were not examined before being placed in service: a) Eastern Metal Recycling Eastern Holding - The propane powered Hyster# 50 was not inspected prior to being placed in service at the facility, increasing employee exposure to a struck by hazard as the industrial truck could be operated with a mechanical deficiency. This was observed on February 6, 2015.
