29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  On or about February 10, 2015, prior to operation, the forklift operators were not trained via a formal instruction, practical training, and a workplace evaluation.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  On or about February 10, 2015, employees performing framing duties on a new apartment complex at a height greater than six feet were doing so without fall protection.
