29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:  A.)  Roberts Warehousing, Inc., 5501 Pennsylvania Route 89, North East, PA  16428, on or about February 10, 2015 and times prior thereto:  Employees perform service and maintenance on equipment including, but not limited to, the vertical baler.  A lockout/tagout program consisting of periodic inspections, authorized and affected employee training, and the emergency removal of locks was not developed, documented, and implemented.  In addition,  specific lockout tagout procedures were not developed and implemented for equipment including, but not limited to, the vertical baler.

29 CFR 1910.1200(e)(1): Employers did not develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met, and which also included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii):  A.)  Roberts Warehousing, Inc., 5501 Pennsylvania Route 89, North East, PA  16428, on or about February 10, 2015 and times prior thereto:  Employees worked with products including, but not limited to, Castle Shop-Solv.  The written hazard communication program was incomplete in that the program did not contain elements including, but not limited to, a description of the labeling system that was used at the facility.
