29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) On February 3, 2015 and at times prior thereto; east area; employees framing a new residential home were observed walking the top plate and working on the outside wall without fall protection in place to prevent them from falling 25 feet to ground level.

29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance was not being conducted at least once every three years:   a) On February 3, 2015 and at times prior thereto; front of residence (Northside); employees were operating an all-terrain powered industrial truck without being re-evaluated at least every three years. The last time the operator was tested was on April 2006.    Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
