29 CFR 1910.178(n)(6): Industrial truck drivers were not required to look in the direction of, and keep a clear view of the path of travel: The employer does not ensure industrial truck drivers are required to look in the direction of, and keep a clear view of the path of travel. This violation occurred on or about February 24, 2015, where an employee on the west side of the Forklift Shop was exposed to a struck-by hazard when working in the path of a Yale GDP 100VX Forklift without the forklift driver keeping a clear view of the path of travel. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that industrial truck drivers are required to look in the direction of, and keep a clear view of the path of travel. In the Alternative: OSH ACT of 1970 Section (5)(a)(1): The employer does not furnish to each of his employees employment and a place of employment which are free from the recognized hazard of being struck-by when using a Yale GDP 100VX Forklift to remove and replace forklift wheel assemblies which are likely to cause death or serious physical harm to employees. This violation occurred on or about February 24, 2015, and times prior thereto, at or near the Forklift Shop, where an employee was exposed to a struck-by hazard when a Yale GDP 100VX Forklift was to used to mount and dismount an approximately 400 pound Taylor TXH 350L Forklift wheel assembly. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation describing the actions it is taking to establish an acceptable method prevent struck-by hazards when mounting and dismounting forklift wheel assemblies.

Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation describing the steps it is taking to ensure that procedures are developed, documented and utilized for the control of potentially hazardous energy when engaged in activities covered by this section.
