29 CFR 1910.178(q)(1): Any power-operated industrial truck not in safe operating condition was not taken out of service, and/or repairs were not made by authorized personnel:  (a)  On February 27, 2015, in the yard adjacent to the main weigh scales of the facility, the Hyster 80 Powered Industrial Truck was found to be in operation with the following defects:          (1) No Operational Emergency Brake.         (2) Non-Operational Side Shifting for the Forklift Carriage.         (3) Improper Vertical Operation of the Forklift Carriage due to excessive rust on the chain.   Abatement certification is required for this item; use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose.
