29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:   Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated.   a) 763 N. Broadway Saratoga Springs, NY. - On or about March 5th, 2015 - Whitbeck Construction Company LLC. employees were exposed to fall hazards while using an aerial lift.  A personal fall arrest system was not worn when working from the aerial lift.

29 CFR 1926.501(b)(14): Each employee working on, at, above, or near wall openings (including those with chutes attached) where the outside bottom edge of the wall opening is 6 feet or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches above the walking/working surface, was not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system.   a) 763 N. Broadway Saratoga Springs, NY. - On or about March 5th, 2015 - Whitbeck Construction Company LLC & Northern Dean Inc. employees were working on, at, above, or near wall openings where the outside bottom edge of the wall opening was approximately 17 feet or more above a lower level.  Employees were exposed to fall hazards of approximately 17 feet in height.
