29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): a) Machine Shop - Employees who operated the facilitys two Mitsubishi propane forklifts (model FGC25K, serial number AF82C-02754, and model FGC25, serial number AF82B-06575) were not trained per the requirements of the standard. On or about 3/10/15. Abatement Note: Forklift operator training consists of a combination of formal instruction (e.g., lecture, discussion, interactive computer based training, video tape, written material, etc.), practical training (demonstration performed by the trainer and practical exercises performed by the trainee), and an evaluation of the operators performance in the workplace. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative: a) Production areas - An effective lockout program including written procedures and employee training was not developed or implemented for production equipment such as, but not limited to the Thermwood CNC machines, the Mayer PS 9Z beam saw, the Weeke Point to Point CNC machine, and the Giben Edge Division edge banding machine. On or about 3/10/15. Berg East Imports, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.147(c)(1) which was contained in OSHA inspection number 314581091, citation number 1, item number 1, and was affirmed as a final order on 8/12/10, with respect to a workplace located at 120 E. Gloucester Pike, Barrington, New Jersey 08007. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
