29 CFR 1926.403(b)(2): Listed, labeled, or certified equipment was not installed and used in accordance with instructions included in the listing, labeling, or certification:  a) For employees working at 120 Neptune Lane in Holmes Beach, as observed on or about March 17, 2015. Employees were using metal electrical boxes as extension outlets for the temporary wiring that were not used in accordance with the manufacturers listing and labeling instructions.    b) For employees working at 120 Neptune Lane in Holmes beach, as observed on or about March 17, 2015. Employees were using Romex brand solid copper wire as the supply cord for the metal electrical boxes that were used as extension outlets. Romex brand solid copper wiring is designed to be used as permanent installed affixed wiring.

29 CFR 1926.405(g)(2)(iv): Flexible cords were not connected to devices and fittings so that strain relief is provided to prevent pull from being directly transmitted to joints or terminal screws:  a) For employees working at 120 Neptune Lane in Holmes beach, as observed on or about March 17, 2015. Employees were using Romex brand solid copper wire as flexible wiring for the supply cord of the metal electrical boxes that were used as extension outlets. The wiring did not have strain relief at the point of entry into the metal box to prevent the pull from directly being transmitted to the terminal screws.

29 CFR 1926.405(b)(1): Conductors entering boxes, cabinets, and fittings were not protected from abrasion:  a) For employees working at 120 Neptune Lane in Holmes beach, as observed on or about March 17, 2015. Employees were using Romex brand solid copper wire as flexible wiring for the supply cord of the metal electrical boxes that were used as extension outlets. The wiring did not have a fitting at the point of entry into the metal box to protect the wire from abrasion.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  a) For employees working at 120 Neptune Lane in Holmes Beach, as observed on or about March 17, 2015. Employees were installing floor joists for the third floor of a residential home without the use of fall protection. Employees were exposed to a fall hazard of 8 feet 1 1/2 inches to the second floor and over 30 feet to the ground below.    b) For employees working at 120 Neptune Lane in Holmes Beach, as observed on or about March 17, 2015. Employees were constructing and erecting walls on the second floor with an unprotected edge. Employees were exposed to a fall hazard of approximately 10 feet . to the first floor.    Keith Kleppinger Construction Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501 (b)(1), which was contained in OSHA inspection number 314843392, citation number 01, item number 01 and was affirmed as a final order on September 20, 2010, with respect to a workplace located at 310 68th Street in Holmes Beach, FL.

29 CFR 1926.403(b)(1)(iii): Safety of equipment was not determined on the basis of electrical insulation.   a) For employees working at 120 Neptune Lane in Holmes beach, as observed on or about March 17, 2015. Employees were using an extension cord to power tools that had damaged or removed insulation exposing the three inner conductors to possible damage during use.
