An employee was observed working on a ledge in the excavation that measured 52 inches deep, while the entire excavation was estimated to be 7-8 feet deep. This condition exposes employees to fall hazards while climbing in and out of the excavation.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c).   On or about March 19, 2015 and times prior thereto, at the worksite located at or near 2701 E Race Avenue, Searcy, AR 72143, the competent person had not determined that there was no potential for a cave-in. The excavation was in previously disturbed soil and was subject to ground vibration from the adjacent roadway. Additionally, the ground was saturated due to recent rainfall and the trench had accumulated water in the bottom. Employee(s) had entered the excavation while attempting to find a leak in a water main. The employee(s) were not protected by a protective system exposing them to struck-by and engulfment hazards.
