29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions: 1) On March 18, 2015, and at prior times, an employee was not protected from cave-in hazards when building a retaining wall next to an open excavation. Inspections of the excavation were not conducted to assess situations that could result in possible cave-ins. At the time of the inspection, a portion of the excavation had sloughed off and protective systems had not been implemented.
