29 CFR 1926.403(b)(2): Listed, labeled, or certified equipment was not installed and used in accordance with instructions included in the listing, labeling, or certification.  On or about March 25, 2015 and at times prior thereto, an electrical outlet that was connected to a circular saw via an extension cord was not installed in an outlet box. This condition exposed employees to electrical hazards.        Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1926.404(b)(1)(ii): On a construction site, where an assured equipment grounding program was not utilized, all 120-volt, single-phase, 15 and 20 ampere receptacle outlets which were not a part of the permanent wiring of the building or structure and which are in use by employees did not have approved ground fault circuit interrupters for personal protection.  On or about March 25, 2015 and at times prior thereto, employees used a Mikita circular saw to cut wooden members without being protected from electrical hazards by a ground fault circuit interrupter.   Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1926.405(g)(2)(iii): The repair splice in a hard service flexible cord No. 12 or larger did not retain the insulation, outer sheath properties, and usage characteristics of the cord which was being used.  On or about March 25, 2015 and at times prior thereto, employees used a 7 1/4 inch Makita corded circular saw that had damage to the cord covered with electrical tape.   Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).   On or about March 25, 2015 and at times prior thereto, an employee was replacing a patio roof, approximately 14 feet, 7 inches above the ground without fall protection. 29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards.  At or about March 25, 2015 and at times prior thereto, American Best did not provide a training program for employees who may potentially be exposed to fall hazards, thus increasing the chance of a fall occurring.
