29 CFR 1915.152(a): The employer did not provide or ensure each affected employee with the appropriate personal protective equipment (PPE) for the eyes, face, head, extremities, torso, and respiratory system, including protective clothing, protective barriers, personal fall protection equipment, and life saving equipment, meeting the applicable provisions of Subpart I, wherever employees were exposed to work activity hazards that required the use of PPE. At this workplace, the employer did not provide employees protective clothing for the prevention of burns caused by flying hot molten metal sparks in the cutting yard area, during shipbreaking operations.

29 CFR 1915.152(b)(1): When hazards were present, or likely to be present, the employer did not provide personal protective equipment that would protect the affected employee based on the workplace hazard assessment. At this workplace, employees conducted shipbreaking cutting operations in the dismantling yard, the employer did not conduct an adequate hazard assessment, and did not address employees exposed to burns caused by hot molten metal sparks flying throughout the workplace and landing on employees.
