29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  a. On March 30, 2015, employees were performing roofing work on the approximately 10 inch on 12 inch pitched roof of a two story residential house located at 664 Concord Court in Westerville, Ohio. Employees were not utilizing fall protection, thereby exposing employees to an approximately 18 foot fall hazard.

29 CFR 1926.1053(b)(10): The top of a non-self-supporting ladder shall be placed with the two rails supported equally unless it is equipped with a single support attachment.   a. On March 30, 2014, employees were using an aluminum extension ladder to access the roof on the garage of a residential house located at 664 Concord Court in Westerville, Ohio. The top rails of the ladder were placed at an angle against the edge of the roof, creating an unstable condition, thereby exposing employees to a maximum fall hazard of approximately 12 foot.
