OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:      The employer is failing to protect employees from potential struck by hazards associated with operating an industrial truck/tractor with unauthorized modifications.  This was most recently evident during the inspection of the facility located at 303 E. Railroad St., Eustis, NE, where the employer has employees operating a Wrangler articulating loader with unapproved modifications to move dry fertilizer and its ingredients throughout the facility.  Modifications include but are not limited to:                  i.  On the Wrangler articulating loader the employer had removed the factory installed roll over protection which provided overhead protection, in lieu of an in house made roll over bar which did not provide overhead protection.          Among other methods, feasible and acceptable methods of abatement are:      1.     The employer shall reinstall the ROPs protection that came installed with the loader in accordance with manufacturers specifications or have the current ROPs reviewed by the manufacturer and if they approve get an approval letter.
