29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents  a) Worksite, 10 Old Riverhead Rd., Riverhead, NY- Employee in front section of roof was using a pneumatic nail gun to install roofing shingles was not wearing eye protection; on or about 4/1/15.  b) Worksite, 10 Old Riverhead Rd., Riverhead, NY- Employees in back section of the roof were using pneumatic nail guns to frame a soffit were not wearing eye protection; on or about 4/1/15.   Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:  Instance a) Worksite, 10 Old Riverhead Rd., Riverhead- Employee in front section of the roof was observed working on a 5/12 pitch at a height of approximately 20 feet while not protected from falling by the use of guardrail, safety net or personal fall arrest systems; on or about 4/1/15.  Instance b) Worksite, 10 Old Riverhead Rd., Riverhead- Two employees in back section of the roof were observed working on a 5/12 pitch at a height of approximately 12 feet while not protected from falling by the use of guardrail, safety net or personal fall arrest systems; on or about 4/1/15.  Note:  In addition to abatement certification the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  Instance a) Worksite, 10 Old Riverhead Rd., Riverhead- Employees were observed climbing an extension ladder to access the roof in the back of the building. The side rails extended approximately 20" above the landing; on or about 4/1/15.   Note:   Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.
