At the Creekside Park Apartments, 2120 Stephens Place, New Braunfels, TX 78130, on 31 March 2015 and at times prior thereto, at least two workers were working to unload materials on a job-site made, wooden trash box supported by the forks of a rough terrain forklift. The trash box was elevated to upper levels, a height of ten feet or higher, of an apartment building under construction exposing the workers to the hazard of falling from a height of more than ten feet.

The trash box was elevated to upper levels, a height of ten feet or higher, of an apartment building under construction exposing the workers to the hazard of falling from a height of more than ten feet. 1- The scaffold was found on the worksite by the employer 2- The scaffold was not designed by a qualified person 3- A decal stating to lift or lower personnel only in an approved work platform was located on the quick attach end of the boom head prior to lifting personnel. 4- A JLG decal was not installed on the quick attach end of the boom head prior to lifting personnel in a JLG supplied/approved personnel work platform.
